The stay was awarded in the NSW Civil and Administrative Tribunal on Friday, 31 October, following Cr Thaler challenging his third suspension.

Cr Thaler has halted the suspension, handed down by the Office of Local Government on October 29.

"Mr Thaler lodged an application for a stay of his third suspension which was granted by Justice Coleman of the NSW Civil and Administrative Tribunal (NCAT) on 31 October 2025," the Office of Local Government spokesperson said.

"The Office of Local Government is disappointed with this outcome but accepts the Judge’s decision. OLG looks forward to representing its position in the outstanding matters regarding Councillor Thaler that are progressing before the Tribunal.

"After serving two consecutive three-month suspensions following findings of misconduct by the OLG, Councillor Thaler is due to resume his position on Snowy Monaro Regional Council on 5 November 2025."

Cr Thaler was suspended for three months on Wednesday, 29 October, for alleged breaches of council’s code of conduct.

The OLG stated Cr Thaler allegedly breached the code through a series of social media posts, videos and other online comments made during May, July and August.

Cr Thaler is appealing his suspension order.
